4. Arbitration Proceedings

Arbitration agreements often specify that the arbitration proceedings will be conducted according to the rules of a particular alternative dispute resolution organization such as the AAA (American Arbitration Association) or JAMS (Judicial Arbitration and Mediation Services).

a. Selection of Neutral Arbitrator

1) Parties’ Agreement

The parties’ agreement may specify the method by which the arbitrator (or arbitrators) will be selected. If the agreement calls for a single arbitrator, each party must agree on the selection. If the arbitration agreement calls for a panel of three arbitrators, each side typically selects one arbitrator, and those 168

arbitrators agree on the selection of the third arbitrator.
